With the number of family trusts in Australia presently reported to be about 928,000, an understanding of the nuances of their administration is a clear necessity. For much of the past this requirement has revolved around satisfying ATO requirements relating to the distribution of net income or its components and other tax considerations. While these remain, the interplay between these trust structures and the expectations of next generations of the controlling family are raising new challenges and different questions to be addressed by trust controllers and their advisors. The law with regard to these issues is evolving, primarily through decisions of the Courts as individual challenges are being made and determined.
